Welcome to the website of Abodements LLC DBA Virginia Washer Dryer ("we," "us," or "our") at www.virginiawasherdryer.com. These Terms of Service ("Terms") govern your access to and use of our website (the "Site"), including applications, e-signatures for rental agreements ("Rental Agreements"), payments via Stripe, auto-pay setup, and our affordable residential washer/dryer rental services ("Services"). By accessing the Site, submitting an application, providing contact info, or e-signing a Rental Agreement, you agree to these Terms (including electronic acceptance under E-SIGN Act), represent you are 18+, and consent to SMS/email communications. If you do not agree, do not use the Site/Services.
We may update Terms; continued use means acceptance.
1. Rental Services
Affordable rentals of residential washers/dryers for budget minded individuals in Virginia.
Applications via Site; approval based on info provided. E-signed Rental Agreements are binding.
Services include delivery, setup, maintenance. Rentals: You do not own the Equipment. You do not acquire any ownership rights in the Equipment by making the scheduled payments under this lease.
2. Payments & Stripe/Auto-Pay
Payments via Stripe (one-time or auto-pay). Authorize debits/recurring charges; insufficient funds incur fees per Rental Agreement.
Late payments: reminders via email/SMS; fees apply.
Stripe terms apply (see stripe.com). We are not liable for Stripe errors; you're responsible for timely payments.
Termination: Cancel auto-pay via Site; late payments may suspend Services. See full terms and conditions in rental agreement.
3. SMS/Email Communications
By providing phone/email, you consent to reminders/updates (TCPA/CAN-SPAM compliant). Reply STOP to opt-out SMS; unsubscribe emails included. Msg/data rates may apply.
4. Use of the Site
For applications, e-signatures, payments only. No misuse (e.g., fraud, spam).
5. Intellectual Property
Site content ours; no unauthorized use.
6. Arbitration Agreement (Opt-Out Available)
IMPORTANT: Read Carefully. Disputes resolved via binding arbitration (not court), individual basis only (no class actions).
Covered Claims: Any disputes re: Site, Services, Rental Agreements, payments, communications (broad as FAA allows).
Opt-Out: Mail signed notice (name, address, phone, agreement # if any) within 30 days to: Virginia Washer Dryer, 500 E. Pennsylvania Ave. Crewe, VA 23930. We'll confirm.
Process: JAMS rules; you pay court-equivalent filing fee max. Location: Crewe, VA area. Opt-out doesn't affect other terms.
Small claims court option preserved. Full details upon request.
7. Limitation of Liability
"As is." No indirect damages. Liability capped at payments made.
8. Termination
We may terminate for violations/non-payment.
9. Governing Law
Virginia law; disputes in Nottoway County courts (except arbitration).
